NZ POLICE RELEASE HATE CRIME INFORMATION UNDER OFFICIAL INFORMATIONS ACT: Police release its responses to some recent Official Information Act requests where it is considered they contain data and information that has wider public interest

POST MARCH 15TH 2019 NZ GOVT INTRODUCED ‘ POLICE STATE ‘THOUGHT POLICING: Beyond 2019 and beyond 2024. If a person does not like what you say to them they can report this to the police, the police will give that person a reference number, that they can use time and time again. This record can be obtained by the judiciary if a person has to attend court at any time.
THE FOLLOWING IS DOCUMENTED ON THE NZ POLICE WEBSITE:
POLICE DATA DOES NOT MEAN THAT HATE IS MOTIVATED: Hate does not have to be proven, a motivating factor. Hate is based on a ’Persons Perception’ . In other words its self-determined. The so called witness to a perceived hate speech can report this to the police. The receiver of the perceived hate speech can report this to the police
HATE SPEECH CAN BE BY WAY OF BIAS OR PREJUDICE: Data shown does not mean that Hate has been proven to be a motivating factor. However . as of 2019 NZ Police can record ‘hate’ as a motivating factor to any crime or non-criminal incident.
RUBBISH IN- RUBBISH OUT- Data In and Data out. There has been an increase of reports since August 2019, but that does not necessarily mean the overall level of hate crime is motivated crime in NZ has grown, but rather could reflect increased awareness, improving reporting and recording of these crimes. It will be several years until the underlying level of hate motivated crime in NZ becomes clear through data
HATE CRIME IN NEW ZEALAND IS BASED ON A PERSONS PERCEPTION: Means anyone, including the call taker, police officer, victim or witness believe that a crime was motivated by Bias or Prejudice, it will be flagged in the Police System as ‘Perceived Hate’. Any further investigation carried out or any subsequent Court proceeding will be considered under the Sentencing Act 2002 (Section 9 (1) (h)
PERCEIVED HATE SPEECH ‘ COURT HEARINGS’. Under the Sentencing Act 2002 (1) (h) Section 9 The Judicial may determine whether hate is confirmed as the motivation for the offence before the court, whatever that offence may be.
NZ POLICE RECORD REPORTED HATE MOTIVATED CRIMES: And incidents based on a persons perception. States ‘Given the dynamic nature of Police Systems and the possibility of a future investigation- outcomes, records and data may have changed, or could change in the future since the data was originally released.

POLICE HAVE WORKED OUT THEIR OWN DEFINITION OF HATE CRIME: 24th April 2024 Police have worked out a working definition of Hate Crime ‘It is perception based’ The perception is recorded. HATE MOTIVATION OR PREJUDICE: Where Police records an offence and identifies the Hate or Prejudice formed part of or whole of the motivation behind the offence this file is flagged as ‘Hate Crime’. Any recorded offences can be flagged for having a ‘Perceived Hate’ as a contributing factoir. Police have developed a working definitions in relation to hate crime, hate incidents and hate speech as adopted from a broad landscape of definitions and terminology across agencies and communities within Aotearoa NZ and internationally for Police specific operational purposes
CAPTURE THE DATA ON FLAGGED AS HATE CRIME: Police definition of Hate Crame is Perception Based. For each offence flagged as perceived hate police are required to capture the ‘protected characteristic’ targeted, were targeted. Police can record multiple ‘Protected Characteristics’ against each offence.
PERCEIVED CHARACTERISTIC OF HATE CRIME: The subcategory of Protected Characteristic, there is a ‘Perceived Characteristic’ which provides more glandular data about the identity of the person targeted by that offence. BREAKDOWN OF ALL HATE CRIME INCIDENTS JANUARY 2023 – FEBRUARY 2024 (OIA Request & Response) By the type of offence reported Again using Hate Crime as defined by the Police as a ‘Potential Hate’ motive’. Protected Characteristic and Perceived Hate Crime . Police are committed to continuing the development of reporting capabilities, to provide more detailed data when they are able to do so
THE HATE CRIME QUALITY ASSURANCE TEAM AUDIT: These developments can include work by the Hate Crime Quality Assurance Team to audit, update improve historical data, as capabilities advance, further detailed data will be available (6 Pages ) In Total 5,585 Hate Crimes 1st Jan 2023- 29th February 2024. HOW MANY CHARGES OF HATE CRIME HAVE POLICE LAID?: OIA Request to NZ Police 4th April 2024 Also what are * outcome of these cases where a charge was laid . The response to this OIA Request by NZ Police was 1 Page which read : Police systems do not currently facilitate automatic reporting on the outcome of hate related occurrences.
NZ POLICE ‘GATHERING OIA REQUESTED INFORMATION: Will require significant manual work or creation of new reporting systems. Therefore your request is refused under Section 18f of the OIA as the information requested cannot be made available without substantial collation of research.
